Terms of Service

These Terms of Service govern your use of Esimu, a travel connectivity service operated by Travona LLC, a Massachusetts limited liability company registered in the United States.

By creating an account, purchasing a plan, installing an eSIM, using Esimu, or accessing our website or services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Esimu.

1. Plain-English Summary

This summary is provided for convenience only. The full Terms below control if there is any conflict.

  • Esimu sells travel eSIM plans that help you connect while traveling. Most plans are for mobile data, but some bundles may include voice calls, SMS, or a local number if clearly stated in the plan details.
  • Plans depend on third-party connectivity partners, mobile network operators, roaming partners, your device, your destination, and local network conditions.
  • You are responsible for confirming that your device is eSIM-compatible, unlocked, and suitable for the plan you buy.
  • Your eSIM is delivered to you right after purchase, but your plan does not start running then. For most plans, the validity period begins when your eSIM connects to a supported network at your destination. For some plans it begins when you install it. Your plan details say which rule applies. You can usually install the eSIM before you travel without starting the clock, as long as your plan activates on network connection.
  • Because the eSIM is delivered to you immediately, your refund rights are limited. Unused and unactivated plans may be refunded within 7 days after purchase, subject to the plan rules. Once a plan is installed (where the plan activates on installation), activated, connected to a network, or used, it is generally non-refundable.
  • If your eSIM cannot connect, you must contact support before the plan expires so we can troubleshoot.
  • Esimu plans are not meant for emergency communications. Do not rely on Esimu as your only way to contact emergency services.
  • For some destinations or orders, we may ask you to verify your identity before activation, and some destinations legally require it. We collect and share certain data as described in our Privacy Policy.
  • You may not resell, share, transfer, abuse, or misuse Esimu plans or activation details, except as expressly allowed for business or guest use under Section 19.
  • Filing a payment dispute that is fraudulent or abusive, or that concerns a plan you have received, activated, or used, can result in account suspension and blocked future purchases.
  • We may send service messages by email, SMS, messaging app, in-app notification, or other contact methods you provide. We will send marketing messages only if you have opted in, and you can opt out at any time.
  • These Terms are governed by Massachusetts law. If you are a consumer in a country whose law gives you protections that cannot be waived, those protections still apply to you.

2. Who We Are and Definitions

Esimu is a brand and service operated by Travona LLC, a Massachusetts limited liability company registered in the United States.

In these Terms:

  • "Esimu," "we," "us," and "our" mean Travona LLC operating the Esimu service.
  • "You" and "your" mean the person or business using Esimu.
  • "Plan" means an eSIM data, voice, SMS, travel connectivity, top-up, extension, or related service package purchased through Esimu.
  • "eSIM" means an embedded SIM profile or digital SIM service that can be installed on a compatible device.
  • "Connectivity partners" means the third-party eSIM providers, mobile network operators, roaming partners, and other network-side providers involved in delivering connectivity.
  • "Service providers" means the payment processors, identity-verification providers, fraud-prevention tools, analytics tools, communications providers, hosting providers, customer-support tools, and professional advisors that help us operate, secure, and support the service.

3. Eligibility

You may use Esimu only if you are at least 18 years old, or the age of majority in your place of residence if higher, and you are able to enter into a legally binding contract. By creating an account or making a purchase, you represent that you meet this requirement and that you are not a minor.

Esimu is not directed to children, and we do not knowingly collect personal information from children. If we learn that a minor has created an account, we may close it.

If you use Esimu on behalf of a company, organization, employee, traveler, guest, contractor, or another person, you confirm that you are authorized to do so and that you are responsible for their use of Esimu.

4. What Esimu Provides

Esimu is a reseller of travel connectivity. Esimu provides travel eSIM plans that allow compatible devices to connect to mobile networks in supported destinations.

Esimu is not itself a mobile network operator and does not own or control the underlying networks. Service is delivered through third-party connectivity partners, mobile network operators, roaming partners, infrastructure providers, and other service providers, and depends on their networks, coverage, and rules.

Most Esimu plans are data-only. Some plans may include voice calls, SMS, a local number, or other features where clearly stated in the plan details. Features vary by plan, destination, device, and connectivity partner.

5. Data-Only, Voice, SMS, and Emergency Services

Unless the plan details clearly state otherwise, Esimu plans do not include voice calls, SMS, a local number, or emergency calling.

Even where a plan includes voice or SMS, Esimu plans are intended for travel connectivity and are not designed, guaranteed, or recommended for emergency calls, emergency SMS, or emergency communications.

Esimu plans are not a substitute for a reliable means of contacting emergency services. You must not rely on Esimu as your only means of contacting emergency services, public safety authorities, medical providers, family members, travel providers, or any other person or organization in an emergency.

This Section does not limit any emergency-calling capability built into your device by its manufacturer or operating system, which operates independently of your Esimu plan.

6. Accounts

Customers must create an account to use Esimu.

You are responsible for keeping your account login, password, QR codes, activation codes, eSIM details, devices, and contact information secure. Esimu is not responsible for unauthorized use caused by your failure to protect your account or activation details.

You may not create or use multiple accounts to abuse promotions, avoid restrictions, evade enforcement, bypass verification, conceal identity, or engage in fraudulent or prohibited activity. Esimu may merge, suspend, restrict, or close duplicate accounts where we reasonably believe they are being misused.

You may request deletion of your account through your account settings or by contacting support. We will delete or anonymize your personal information within a reasonable period after your request, except for records we are required or reasonably need to retain for legal, tax, accounting, fraud-prevention, payment, dispute-resolution, security, audit, regulatory, or compliance purposes. Our retention periods are described in our Privacy Policy.

7. Device Compatibility

You are responsible for confirming before purchase that your device:

  • supports eSIM;
  • is unlocked and not restricted by another carrier;
  • supports the network bands and technologies required in your destination;
  • is compatible with the selected plan;
  • is properly configured for roaming, data, and eSIM use.

Esimu may provide device compatibility guidance, but we do not guarantee compatibility with every device, operating system version, device setting, app configuration, carrier lock status, or destination network.

Device incompatibility, carrier lock, unsupported destination bands, incorrect settings, or user installation error are generally not grounds for refund. However, Esimu may review unused and unactivated plans under the refund terms in Section 17.

8. Plan Details, Coverage, and Availability

Plan details may include destination, region, network type, validity period, data amount, fair-use terms, activation rules, supported features, top-up availability, hotspot or tethering availability, voice or SMS availability, and other restrictions.

Coverage, speed, latency, network type, availability, data routing, voice or SMS availability, local number availability, hotspot or tethering availability, and service quality depend on the selected plan, destination, device, local mobile network, roaming partner, coverage area, congestion, fair-use rules, network management rules, laws, and other factors outside Esimu's direct control.

Each plan has an activation or validity policy stated in the plan details. For most plans, the validity period begins when the eSIM connects to a supported network in the plan's coverage area, which usually means when you arrive at your destination. For some plans, the validity period begins when the eSIM is installed on your device, even if you are outside the coverage area. You are responsible for checking the plan's validity policy before purchase so you know when to install. The included data is allotted for the entire validity period and is not divided per day, and a validity period generally cannot be extended once it has started, although some plans allow top-ups where the plan details say so.

Esimu does not guarantee any specific speed, latency, network type, coverage area, uninterrupted service, or continuous availability.

9. Hotspot, Tethering, Routers, IoT, and Other Devices

Hotspot or tethering may be available only where the selected plan, device, and partner network support it. Esimu does not guarantee hotspot or tethering availability unless it is expressly stated in the plan details.

Esimu plans may be used with phones, tablets, laptops, hotspots, routers, IoT devices, trackers, or embedded devices only where the selected plan, device, and partner network support that use. Esimu does not guarantee compatibility with any specific device type unless expressly stated in the plan details.

10. Unlimited Plans and Fair Use

Some plans may be described as "unlimited." Where a plan is described as unlimited, any fair-use thresholds, throttling points, hotspot limits, deprioritization rules, or other limitations that apply will be disclosed in the plan details.

Unlimited plans may still be subject to fair-usage policies, speed reductions, throttling, hotspot limits, deprioritization, network management, service restrictions, or other limitations set by Esimu, connectivity partners, roaming partners, or mobile network operators, where those limits are disclosed in the plan details or otherwise required by the applicable connectivity partner, mobile network operator, roaming partner, or law.

11. Prices, Currency, Taxes, and Payment

At launch, Esimu charges in USD. Esimu may add support for other currencies in the future. Your bank or card issuer may apply a foreign exchange or conversion fee, which is outside Esimu's control.

Prices are shown before purchase. The price you see includes any value-added tax, goods-and-services tax, sales tax, or similar tax that Esimu is required to charge on your purchase, and the tax portion will be shown on your receipt where the law requires it. As merchant of record, Esimu is responsible for collecting and remitting the taxes it is legally required to collect on your purchase.

Esimu uses third-party payment processors, including Stripe, to process payments and to help calculate applicable taxes. By making a purchase, you authorize Esimu and its payment processors to charge your selected payment method.

After purchase, Esimu will provide a receipt or order confirmation by email and through your account. You are responsible for keeping your account and contact information accurate so you can receive order, activation, receipt, support, and security communications.

12. Payment Review and Suspicious Orders

Esimu normally aims to issue eSIM plans after successful payment. However, we may delay issuance for orders that appear high-risk or require additional verification, fraud review, payment review, compliance review, destination-country checks, or connectivity partner approval.

Esimu may cancel, reverse, refund, or hold suspicious orders before issuing the eSIM, even if payment has already been authorized or captured. Where we cancel an order before issuance, we will refund or reverse the payment.

Esimu may refuse, restrict, delay, or cancel orders where required by law, compliance obligations, payment risk, fraud controls, destination-country rules, telecom restrictions, sanctions screening, partner availability, or unsupported coverage.

13. eSIM Delivery and Activation

eSIMs are digital products. Nothing physical ships.

After successful purchase and any required review, Esimu will deliver your activation details (such as a QR code or activation profile) through your account, email, or another supported delivery method. Delivery of these activation details normally happens promptly after purchase.

Delivery is not the same as activation. Activation, and the start of your plan's validity period, happens later according to the plan's activation or validity policy. For most plans, the validity period starts when your eSIM connects to a supported network in the destination coverage area, which usually means after you arrive at your destination. For some plans, the validity period starts when you install the eSIM on your device. The plan details state which rule applies to your plan.

You can usually install your eSIM over a reliable Wi-Fi connection before you travel, and for plans that activate on network connection this will not start your validity period until you reach the coverage area. Install over a reliable connection where possible, because an eSIM can normally be installed only once. Keep your QR code, activation code, and eSIM details private.

By purchasing a plan, you request and consent to Esimu making your activation details available to you promptly after purchase. You acknowledge that the eSIM is delivered to you as digital content at that point, and that once your plan has been installed (for plans that activate on installation), activated, connected to a network, or used, your right to a refund is limited as described in Section 17, and any statutory right of withdrawal may no longer apply as described in Section 31.

If payment succeeds but Esimu cannot deliver or issue the selected eSIM plan, Esimu may attempt re-delivery, provide an equivalent replacement plan, issue store credit, or refund the payment, depending on the circumstances and applicable law.

14. Installation, Deletion, and Reinstallation

You are responsible for following installation instructions and ensuring that the eSIM is installed on the correct device.

Do not delete an eSIM from your device unless instructed by Esimu support or the plan instructions. Some eSIMs cannot be reinstalled after deletion, transfer, or device reset.

If you delete an eSIM from your device, Esimu is generally not responsible for loss of service or replacement. Esimu may help you reinstall, recover, or replace the eSIM where technically possible and allowed by the applicable provider or network rules, but replacement is not guaranteed.

15. Top-Ups, Extensions, and Subscriptions

Some plans may support top-ups, extensions, or additional data purchases. Availability, pricing, validity, activation rules, and refund eligibility for top-ups or extensions depend on the selected plan and connectivity partner rules.

Most Esimu purchases are one-time prepaid plans unless the plan details clearly state otherwise.

If Esimu offers subscriptions, auto-renewals, recurring top-ups, or similar recurring services, then before you enroll we will clearly disclose the goods or services, the recurring charge, the billing frequency, and how to cancel, and we will obtain your affirmative consent to the recurring charge. You will be able to cancel a recurring plan easily through your account or by contacting support, and cancellation will stop future charges going forward.

16. Plan Changes, Substitutions, and Changes to the Service

Esimu may modify, suspend, discontinue, replace, substitute, or limit any part of the service, including plans, prices, destinations, networks, connectivity partners, providers, features, coverage, top-ups, subscriptions, refund options, or account features, where required because of availability, coverage, technical, regulatory, commercial, security, or partner-related reasons.

If a change materially affects an unactivated plan you have already purchased, Esimu will provide notice where reasonable and may offer an equivalent replacement, store credit, refund, or other reasonable remedy where appropriate.

17. Refund Policy

Esimu aims to be fair, but eSIM plans are digital connectivity products and refund eligibility is limited. Some plans cannot be cancelled once issued because of connectivity partner rules; where that applies, it will be noted in the plan details.

17.1 Unused and unactivated plans

Receiving your activation details (such as a QR code) does not by itself make a plan ineligible for a refund. A plan is eligible for a full refund or store credit only if all of the following are true:

  • the plan has not been activated, connected to a network, or used, and (for plans that activate on installation) has not been installed;
  • the plan's validity period has not started;
  • the request is made within 7 days after purchase; and
  • the applicable connectivity partner rules permit cancellation.

A plan is considered activated, and is no longer unused or unactivated, when its validity period has started under the applicable plan rules, which for most plans is when the eSIM connects to a supported network in its coverage area, and for some plans is when the eSIM is installed. A plan is also no longer refundable once it has connected to a network, consumed data, used voice or SMS, or otherwise started its validity period.

17.2 Wrong destination or wrong plan

If you purchase the wrong destination or wrong plan, Esimu may offer a refund or store credit if the plan meets all of the conditions in Section 17.1.

17.3 Technical failure

If an eSIM cannot connect and Esimu cannot resolve the issue, you may be eligible for a refund or store credit. To qualify, you must contact support before the plan expires and give Esimu a reasonable opportunity to troubleshoot. Esimu may ask you to provide screenshots, device settings, error messages, location details, and device information, and to complete reasonable troubleshooting steps. A refund for a technical issue may be denied or limited if you do not reasonably cooperate with troubleshooting or if Esimu cannot verify the issue after reasonable investigation.

Where a plan has already been activated and partially used before a verified technical failure, any refund or credit will be based on the unused portion of the plan rather than the full purchase price. You must report a technical problem promptly, and in any event before the plan's validity period ends, and you must give Esimu a reasonable period to investigate and to attempt a fix or a replacement before a refund is issued. If Esimu provides a working replacement or restores your service within that period, a refund is not due.

17.4 Plans that are not refundable

Except as stated in Section 17.3 for a verified technical failure, or as required by applicable law, a plan is not refundable where:

  • the plan has been activated, connected to a network, consumed, used, or expired, or (for plans that activate on installation) has been installed;
  • the issue is caused by an incompatible, locked, unsupported, or incorrectly configured device;
  • you selected the wrong destination or plan and the plan has already been activated, connected to a network, or used;
  • you deleted the eSIM from your device;
  • you failed to contact support before the plan expired;
  • you refused or failed to complete reasonable troubleshooting; or
  • the plan was suspended or terminated because of fraud, abuse, payment risk, failed identity verification, prohibited use, abusive chargeback activity, sanctions or compliance risk, or violation of these Terms.

Local network coverage, speed, congestion, or availability not meeting your expectations is addressed through the technical-failure process in Section 17.3 and is not otherwise a separate ground for refund.

17.5 Expired unused plans

Plans that expire before a refund request is made, including unused plans, are not automatically refundable. Esimu may review expired unused plans and may offer a refund, replacement, or store credit where appropriate and where provider rules allow.

17.6 Refund method and timing

Esimu may issue refunds to the original payment method or as store credit, depending on the situation, provider rules, payment processor rules, and applicable law. Refund timing depends on the payment processor, card issuer, bank, or other payment provider. Store credit is normally available quickly, while a refund to your original payment method can take up to 30 days to appear, depending on your bank or card issuer.

17.7 Goodwill

Nothing in this Section prevents Esimu from granting a refund or credit beyond these rules at its discretion in your favor.

18. Chargebacks and Payment Disputes

If you have a billing concern, please contact support at support@travona.travel first so we can try to resolve it.

If you file a payment dispute or chargeback that is fraudulent or abusive, or that concerns a plan you have received, activated, or used, Esimu may suspend your account, block future purchases, disable affected plans where allowed, and submit order, activation, usage, support, account, and delivery records to Stripe or the relevant payment processor as permitted by applicable law and card-network rules. This evidence handling is described in our Privacy Policy.

Repeated fraudulent disputes or payment abuse may result in permanent account restriction. Nothing in this Section limits your right to dispute a charge where you are legally entitled to do so.

19. Business, Internal, and Guest Provisioning Use

Esimu plans may be used for personal travel or for a business's internal connectivity needs, including employee travel, field teams, staff devices, supported IoT devices, or similar internal operations.

Hospitality and travel businesses may provision Esimu plans to their travelers or guests only under a separate written business arrangement with Esimu or with our prior written permission. Where guest provisioning is permitted, you remain responsible for your guests' or travelers' use of Esimu, for passing through any required identity-verification or registration steps, and for complying with these Terms and applicable connectivity partner rules.

Except as expressly permitted above or in a separate written agreement, you may not resell, redistribute, broker, sublicense, transfer, share, or commercially exploit Esimu plans, QR codes, activation details, eSIM profiles, accounts, or services.

Esimu may limit or block bulk orders, repeated purchases, unusual purchasing patterns, or high-volume usage where we reasonably believe there is abuse, fraud, prohibited resale, payment risk, network misuse, compliance risk, or violation of these Terms.

20. Acceptable Use

You agree to use Esimu lawfully, reasonably, and in accordance with these Terms, plan details, and applicable partner and network rules.

You may not use Esimu for illegal, harmful, abusive, fraudulent, deceptive, or network-disruptive activity. This includes activity that interferes with networks or systems, harms other users, evades security controls, sends unsolicited communications, misuses numbering or connectivity resources, or violates the rules of Esimu's connectivity partners, roaming partners, mobile network operators, payment processors, or service providers.

You may not scrape, crawl, harvest, or use any automated system to access Esimu's website, platform, or services without our prior written permission, and you may not use Esimu's website, platform, or services, or any content from them, to develop or train any artificial intelligence or machine-learning system or model.

You must not use Esimu in any country or in any manner prohibited by applicable export-control or sanctions laws.

You must comply with applicable rules from Esimu's connectivity partners, mobile network operators, roaming partners, and service providers.

21. Promotions, Credits, and Discounts

Esimu may offer promotional codes, discounts, referral rewards, account credits, or similar benefits.

Esimu may modify, refuse, revoke, cancel, or claw back promotional codes, discounts, referral rewards, account credits, or similar benefits where Esimu reasonably believes they were issued by mistake, obtained through abuse or fraud, used in violation of these Terms, or used in a way that harms Esimu, customers, payment processors, connectivity partners, or mobile network operators.

Promotions may have separate eligibility rules, expiry dates, usage limits, and restrictions.

22. Identity Verification and KYC

Esimu may request identity verification or additional information before or after purchase where required by law, destination-country rules, carrier or connectivity partner requirements, payment compliance, fraud prevention, abuse prevention, or internal risk review.

Some destinations require identity registration as a condition of using mobile connectivity. Where a destination or connectivity partner requires registration or verification, completing it is a condition of activation. If you do not complete a required verification, your plan may not activate, and refunds will follow the standard refund terms for unused and unactivated plans in Section 17.

If you do not provide requested information, Esimu may refuse, delay, suspend, or cancel your order, account, plan, or service.

Where identity verification is required, Esimu may ask you to complete verification through an approved third-party verification service, connectivity partner, or other approved process. Esimu prefers to verify your identity through such services and will avoid storing raw identity documents where possible, retaining only verification status, reference identifiers, and legally required records. How we handle this information is described in our Privacy Policy.

23. Sanctions and Export Compliance

Esimu is operated from the United States and complies with applicable US economic sanctions and export-control laws, as well as applicable destination-country requirements.

By using Esimu, you represent and warrant that you are not a person or entity that is the target of economic sanctions, that you are not located in or ordinarily resident in a country or region subject to comprehensive sanctions or embargo, that you are not owned or controlled by any such person, and that you will not use Esimu in violation of any applicable sanctions or export-control law.

Esimu may screen customers, orders, payment details, and destinations against sanctions and restricted-party lists, and may refuse, delay, suspend, cancel, or terminate any order, plan, account, or service to comply with these laws.

24. Privacy and Communications

Your personal information is handled as described in our Privacy Policy, which explains what we collect, why, who we share it with, how long we keep it, the choices and rights you have, and how to exercise them. By using Esimu you acknowledge that you have read the Privacy Policy.

We may send you service messages about your account, orders, eSIM activation, support, security, and legal or policy updates by the contact methods you provide, including email, SMS, messaging app, or in-account notification, as permitted by applicable law. These service messages are part of providing the service and are not marketing.

We will send marketing messages only if you have opted in. You can withdraw your marketing consent at any time using the unsubscribe or opt-out option, and you will still receive non-marketing service messages.

Marketing consent (captured at signup, not bundled with acceptance of these Terms):

By checking this box, you agree to receive marketing messages from Esimu by email and, where you provide a mobile number, by SMS or messaging app at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time.

25. Suspension, Cancellation, and Termination

For fraud, unauthorized use, illegal activity, sanctions or compliance risk, payment risk, abusive chargeback activity, failed or incomplete identity verification, network misuse, prohibited conduct, or a requirement from a connectivity partner, mobile network operator, payment processor, regulator, or law enforcement authority, Esimu may suspend, restrict, disable, cancel, or terminate any account, order, plan, or eSIM service immediately and without prior notice, even after an eSIM has been issued.

For other, non-urgent breaches of these Terms, Esimu will give you notice and a reasonable opportunity to cure where practical before suspending or terminating.

You may stop using Esimu at any time, but stopping use does not automatically entitle you to a refund.

26. Third-Party Services and Network Partners

Esimu depends on third-party connectivity partners and service providers to deliver parts of the service, including connectivity, roaming, payment processing, identity verification, communications, analytics, support, hosting, and security.

Esimu is not responsible for failures, delays, outages, limitations, policy changes, coverage gaps, throttling, network restrictions, billing-processor delays, or other issues caused by third-party providers, except where required by applicable law.

27. Intellectual Property

Esimu, Travona, our website, platform, software, branding, logos, content, design, text, and graphics are owned by Travona LLC or its licensors.

You may not copy, modify, distribute, sell, reverse engineer, scrape, misuse, or exploit any part of Esimu except as allowed by these Terms or with our written permission.

If you send feedback, suggestions, ideas, or recommendations, you allow Esimu to use them without restriction or compensation.

28. Disclaimers

Esimu is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent allowed by law, Esimu disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, network availability, coverage, speed, latency, compatibility, and error-free operation. Esimu does not guarantee that the service will be available in every location, work with every device, work with every application, meet your expectations, or be uninterrupted, secure, or error-free.

Some warranties and rights cannot be excluded or limited under the laws of the Commonwealth of Massachusetts or other applicable consumer-protection law. Nothing in this Section excludes or limits those warranties or rights, and the disclaimers above apply only to the extent permitted by law.

29. Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, and to the fullest extent allowed by law:

  • Esimu and Travona LLC will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including lost profits, lost business, lost data, missed travel, missed bookings, missed communications, hotel costs, transportation costs, roaming costs, replacement connectivity costs, or other losses arising from or related to Esimu; and
  • Esimu's total liability for any claim relating to a plan is limited to the amount you paid for the affected plan.

30. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Travona LLC, Esimu, and their officers, employees, contractors, service providers, and partners from claims, losses, damages, liabilities, costs, and expenses arising from your fraud, your illegal or unauthorized use of Esimu, your violation of these Terms, or your use of Esimu on behalf of another person or business without authorization.

This Section does not apply to the extent the relevant liability is prohibited from being shifted to you under applicable law.

31. Consumers Outside the United States

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you mandatory protections that cannot be waived by contract, the following applies in addition to the rest of these Terms, and prevails over any conflicting provision to the extent of the conflict:

  • Nothing in these Terms removes or reduces mandatory consumer protections available to you under the law of your country of residence, including any statutory right of withdrawal or cancellation and any mandatory warranty or remedy.
  • For distance contracts, you may have a statutory withdrawal period, for example 14 days in the EU and the UK. Because the eSIM is delivered to you as digital content promptly after purchase, your statutory right of withdrawal ends on the earlier of the end of the statutory withdrawal period or the moment your plan is activated, and you cannot exercise it once you have started to use the plan, to the extent permitted by your local law. Where your local law preserves a withdrawal right despite this, that right continues to apply. Until your plan is activated, and within any applicable statutory period, you may still withdraw and receive a refund.
  • Nothing in these Terms removes your right to bring proceedings in your local courts where that right cannot be waived.

32. Force Majeure

Esimu is not liable for any failure or delay in performance caused by events beyond its reasonable control, including network or carrier outages, acts of connectivity partners or service providers, internet or telecommunications failures, power failures, natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, governmental action, sanctions, embargoes, changes in law, or regulatory orders. This Section does not limit your mandatory consumer rights or any payment Esimu owes you for a plan it cannot deliver.

33. Changes to These Terms

Esimu may update these Terms from time to time. If we make material changes that affect you, we will notify you by email and by an in-account notice, and we may also post the updated Terms. The updated Terms become effective on the date stated in the updated version. Continued use of Esimu after the updated Terms take effect means you accept the updated Terms.

34. Governing Law, Courts, and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Disputes arising from or relating to these Terms or Esimu will be handled in the state or federal courts located in Massachusetts.

If you are a consumer resident in a jurisdiction whose law gives you mandatory protections that cannot be waived by contract, nothing in these Terms removes those protections or your right to bring proceedings in your local courts where that right cannot be waived.

Before filing a legal claim, you agree to contact Esimu at support@travona.travel so we can try to resolve the issue informally.

35. Miscellaneous

Entire agreement and order of precedence

These Terms, together with the plan details, the disclosures shown to you at checkout, our Privacy Policy, our Refund terms in Section 17, and any other policies we reference, form the agreement between you and Esimu. If there is a conflict, the following order of precedence applies, from highest to lowest: (1) mandatory applicable law and your mandatory consumer rights; (2) the specific plan details and checkout disclosures for your purchase; (3) these Terms; (4) any other referenced policy.

Survival

Sections that by their nature should survive termination will survive, including Sections 17 (refunds for amounts owed), 18, 20, 22, 23, 26, 27, 28, 29, 30, 34, and this Section 35.

Notices

We will give you notices through your account, by email, or by another contact method you provide. You must give us formal legal notices by email to support@travona.travel and, where requested, also to the mailing address in Section 36.

Severability

If any part of these Terms is found unenforceable, the rest remains in effect.

Waiver

Our failure to enforce a provision does not waive our right to enforce it later.

Assignment

You may not assign or transfer your rights under these Terms without Esimu's written permission. Esimu may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or transfer of business.
